The above photo was taken on 21 st August 2004 from the conservatory of an existing Eagry Park bungalow, The wooden fence denotes the bungalow's garden boundary.

By 20 August 2004 building was well underway, and the first dwelling (of the proposed 66) had reached second storey. But it was the wrong type. What SHOULD have been built was type MD41E and this is what was approved by the Planners for this particular site on the development. Type MD41E has no second storey windows and Velux windows in the roof instead, to avoid the problems of overlooking. But as can be seen from this photograph there were windows on the second floor which peer directly down into the existing Eagry Park bungalows. The eaves of the actual building would appear to be some 17 feet above the First Floor Level whereas the eaves of what was approved to be built here were only supposed to be 14 feet from FFL.
 
Enforcement were alerted on 17th August 2004 to this "Failure to comply with a condition of Planning Permission". The Enforcement section of the Sub-Divisional Planning Office (Coleraine) visited the site, and on 26th August 2004 issued a warning letter ...  
"...advising the developer that a breach had occurred and that they are proceeding at their own risk. ....As no response has been received from the builder, the Department now intends to send a final warning letter seeking compliance with the approved plans."
Subsequentley, the builders removed the exterior top-storey walls of this dwelling and re-built the approved (lower level) dwelling type MD41E .
