And here are photos of the very first building of the 66 to be built on the site to reach second floor level. This photo was taken from the conservatory of an existing Eagry Park bungalow, The wooden fence denotes the bungalow's garden boundary. But this is not the house type which had been approved by the planners for this particular site. The approved one has no rear windows on the second floor looking at the existing bungalows. Instead it has "Velux" windows in the roof, thus removing the overlooking aspect. The eaves of the approved one are 14 feet, whereas the eaves of what has actually been built here would appear to be 17 feet high. The developer has totally ignored the approved plan and instead built this monstrosity peering directly down into these people's bedrooms and gardens. A deliberate cynical disregarding of the Planning Decision? Or perhaps an honest mistake by the developer who looked at the wrong plan. We understand the Enforcement Officer was informed. |

The Enforcement section of the Sub-Divisional Planning Office (Coleraine) visited the site and on 26th August 2004 issued "...a warning letter advising the developer that a breach had occurred and that they are proceeding at their own risk. ....As no response has been received from the builder, the Department now intends to send a final warning letter seeking compliance with the approved plans." The top storey blocks was then removed and the approved house type built. |
