ENFORCEMENT - Rear fences (updated October
2006)19.00-10/23/06 |
|
Now this was not an official complaint but when writing to Planning
about the external finish of these houses I included this photo (below) |
 |
And my lettter included the following closing sentence... |
This
photo was taken from the Straid Road (one of the tourist routes
to Ballycastle) showing some of the backs of these dwellings. Incidentally
I need hardly point out the two metre high fencing! |
|
| Well the Enforcement Department of Coleraine Planning Service (no doubt
always willing to please) took this to be an official complaint and replied
as follows... |
Following an investigation of your complaint I
can confirm that the above (Alleged u/a 2 m high fence) is considered
to be permitted development under Article 41 of the Planning (General
development Order)(Northern Ireland)(1993) |
|
| How interesting. I had guessed the fencing was allowed but now wondered
what that quoted document had to say about it. So I bought a copy from The
Stationery Office. and read the booklet from cover to cover.
Nope- no Article 41. It only went up to Article 23! I even rang the TSO
and they looked at their own copy and confirmed I had all the pages.
So when writing to the Divisional Planning Manager on another topic I
mentioned this confusion. She replied... |
I apologise
for the error and confusion caused; the letter should have referred
to The Planning (General Development Order)( Northern Ireland)
1993 Schedule 1, Part2, Class A - permitted development. |
|
| So no Article 41 at all then. That was a waste of six quid. Now I am
not suggesting this is deliberate, but I do occasionally have a sneaking
wonder if people in some walks of life, not necessarily Planning, give
you vauge answers in the hope that you will be satisfied and go away. It's
just a thought. |
