Here is one of the dwellings on the Eagry Gardens site. Let's look at this building and see how it relates to the original "accepted" plan and how the Planners have since dealt with these "transgressions" ...

  • It is not built in the position as defined in the original plan. It could well be several metres nearer the existing (white) bungalow in the background.
    To which the planners responed as follows...
  • The grey exterior was not on the plan. The accepted plan shows a yellow exterior (all 30 of the other dwellings are also gray instead of yellow.)
    To which the Planners responed as follows... Although the decision notice is not open to interpretation, the rules of expediency apply, i.e. whether it would be feasible to insist upon a change of something that is not exactly permitted; in this instance, the 'roughcast' nature of the finish is supplied by pebble-dashing, and it is only the slight change of colour that is the discrepancy; (My emphasis. Dictionary definition - "Expedient" = Advantageous rather than right or just).
  • The guttering and facia boards should be black (not white) The same applies to all 30 of the similar dwellings on this site.
    To which the Planners responded as follows...
