PLANS DIFFER
"When a Planning Application is amended in a significant way , the Planning Service will tell those neighbours already notified and people who have already commented. Substantial change normally involves the submission of a revised application"

Because of so many different versions, we wrote to the Divisional Planning Manager on 18th March 2004 asking what Layout Plan/Drawing number was finally approved by Planning Service and taken to Moyle Council in November 2003? . We have subsequently (7/4/04) received a reply stating the approved plan was drawing no. 02/55:02 (30th May 2003). Would we have been told this was the approved plan if we had sat back and not enquired?
BUT THIS PLAN HAS NEVER BEEN PUBLICLY ADVERTISED AS AN AMENDED PLAN!
"Sometimes the person applying may change an application while we are considering it. When that happens, we will tell neighbours or advertise a change if we think it is necessary. You will then have a chance to comment on the new proposal."

Looking at the "approved" plan, - of the 26 proposed new dwellings which directly abut onto the established Eagry dwellings, 21 of them have been changed from the published version. (17 moved nearer and four moved further away)

Here are a couple of examples:-

A proposed semi detached 2-storey house has been moved a third nearer (4m) to the boundary of an existing Eagry bungalow. And what of the smaller alterations? The change of a metre here or there might be viewed as "fine tuning" but with buildings in such close quarters, measurements are vital. Spare a thought for an existing Eagry bungalow that has had a proposed 2-storey house moved yet another metre nearer to the boundary making it now less than 4 metres away. (That's about 13 feet)

This plan  (dwg 02/55:02), which includes these changes has never been advertised as an amended plan in the local Press.

Imagine a single planning application being submitted for a couple of dwellings and then the applicant changes their mind and wants to move one proposed house a third (some 4 m) nearer an established dwelling, or perhaps wants to change the house type completely? Or even drop one of the houses from the application. Or perhaps the applicant proposes to move the road 11 metres? Would the Planning Service take any action? They haven't in this case. Perhaps they look upon it as fine-tuning?

On 18th Of April 2004 we wrote to the Divisional Planning Manager, pointing out all these differences and asking that the "approved" plan should be re-advertised. We had no reply, not even an acknowledgement. So four weeks later we sent another copy, only this time requiring a signature on delivery. We quickly received an acknowledgement this time

"If you have raised any points which you want us to answer, we will send you a reply as soon as possible, normally within 15 working days"

Eventually, on 25th May, we received a letter, apologising for not acknowledging our original correspondence, and saying the points raised ".....will be fully considered before any decision is issued on these applications"

On 28 May 2004 the Case Officer wrote to the Divisional Planner Manager, on our behalf, asking if ... "Planning Service was in a position to comment on Mr and Mrs Willis's letter dated 18th April" (i.e. our concerns re the huge number of differences in the unadvertised plans).As far as we know he never did get a reply. Our request was ignored. The amended plan has not been advertised but instead given the go-ahead.

See next page for list of changes and the reply by the Divisional Planning Manager when we queried why none of this was advertised... you'll be surprised. On second thoughts you probably wont be.
